General Conditions of Sale (GCS)

1. Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by GellyBall Factory.

2. Products

The products offered are those listed on the website www.gellyballfactory.fr , within the limits of available stocks.
Each product is presented with a description and non-contractual photos.

3. Price

Prices are shown in euros, including VAT.
GellyBall Factory reserves the right to change its prices at any time, but the product will be invoiced based on the price in effect at the time the order is validated.

4. Order

The Customer places an order via the website.
Any order implies acceptance of the prices and descriptions of the products, as well as these General Terms and Conditions.
The Seller reserves the right to refuse any order for legitimate reasons (suspected fraud, non-payment, previous dispute, etc.).

5. Payment

Payment is due immediately upon ordering.
It can be done via the secure payment methods offered on the site (bank card, PayPal, etc.).

6. Delivery

Delivery terms are specified in our Delivery Policy.
The Seller shall not be held liable for delays or losses attributable to the carrier.

7. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise his right of withdrawal, without justification.

The product must be returned in perfect condition, in its original packaging.
Return costs are the responsibility of the Customer.
Refund will be made within 14 days of receipt of the return.

The right of withdrawal does not apply to personalized or used products.

8. Warranty

All products sold benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

9. Liability

GellyBall Factory cannot be held responsible for non-performance of the contract in the event of force majeure (fire, strike, flood, pandemic, etc.) or improper use of the products by the Customer.

10. Personal data

The information collected is necessary for order management.

11. Intellectual Property

All elements of the site (texts, images, logos, products) are protected by intellectual property rights.
Any reproduction is prohibited without prior written permission.

12. Applicable law

These T&Cs are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action.
Failing this, the competent court will be that of the place of residence of the Customer or the headquarters of the Seller.
